2. The petitioner apprehends his arrest in a case registered for the offence under Sections 33, 41 & 42 of the Indian Forest Act.
3. On the alleged date and time of occurrence, petitioner alongwith others were seen cutting the Seisum tree under the forest area.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence and has been made accused only on suspicion. Learned counsel for the petitioner further submits that the alleged occurrence took place on 15.03.2004, but the First Information Report was lodged on 29.05.2012. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the delay in lodging the F.I.R. and clean antecedent of petitioner, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in connection with Complaint Case No. 389C2 of 2012, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
