The petitioners seek bail in Bachhwara P. S. Case No. 187 of 2015 instituted for the offence under Section(s) 328 and 302/34 Indian Penal Code.

Learned counsel for petitioners has submitted that police after investigation has submitted final form showing mistake of fact against these petitioners, but the learned Magistrate differing with the police report took cognizance against petitioners. It has come during investigation that deceased was having love affairs with one Rani who happens to be sister of petitioners and subsequently the marriage of the

Patna High Court CR. MISC. No.28126 of 2019(3) dt.29-05-2019 2/2 girl was fixed to another place and for this reason the son of informant consumed poison and committed suicide. The other co-accused of this case have already been granted regular bail by co-ordinate Bench of this Court vide orders passed in Cr. Misc. no. 19639 of 2016 and 14175 of 2016.

Petitioners are in custody since 4.2.2019.

Considering the aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the J.M. 1st Class, Teghra, Distt. Begusarai, in connection with Bachhwara P. S. Case No. 187 of 2015 subject to the condition that both the bailors shall be the close relative of the petitioners.
