2. Earlier, the prayer for grant of anticipatory bail to the petitioner was dismissed as withdrawn vide order dated 16.05.2023 passed in Cr. Misc. No. 10961 of 2023 as petitioner had been granted the benefit under Section 41 of the Cr.P.C..
3. The petitioner apprehends her arrest in a case registered for the offence punishable under Sections 341, 323, 307, 379, 447, 504, 506 and 34 of the Indian Penal Code.
4. As per prosecution case, on the alleged date and time of occurrence, on account of petty dispute between the children of two families, all the FIR named accused persons, including this petitioner, entered into the house of the informant and started abusing and assaulting the informant and her

5. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. As a matter of fact, on account of petty dispute between the children of both the families, a simple scuffle took place. There is case and counter case. Allegation of assault is general and omnibus and no specific accusation of overt act has been alleged against this petitioner. Doctor has found the injuries, sustained by the injured, as simple in nature. Moreover, similarly situated co-accused, namely Chandan Choudhary and Nigam Devi, have already been granted the privilege of anticipatory bail by this Hon'ble Court vide order dated 28.06.2024 passed in Cr. Misc. No. 30446 of 2024. Petitioner is a lady and claims clean antecedents.
6. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
7. Considering the facts and circumstances of the case, general and omnibus nature of accusation, claim based on parity, nature of injuries sustained by the injured and clean antecedents of the petitioner, the prayer for grant of anticipatory

8. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Ist, Khagaria in connection with Parbatta P.S. Case No. 166 of 2021, subject to condition as laid down under Section 482(2) of the B.N.S.S.. (Prabhat Kumar Singh, J) shashank/- U T
