In this case, the petitioner is apprehending his arrest in connection with Barahiya P.S. Case No. 155 of 2016 registered for offences under sections 420/406/353/120B /34 of the Indian Penal Code and Section 66 of the I.T. Act. As per First Information Report, the petitioner gave a call to the Officer-in-charge, Barahiya police station that he was escorting the arms smuggler and will get them arrested by the police, whereafter, on the next day, he called the police to deposit money for payment to be paid to the vehicle agency and, thereafter, no call was received.

This is completely a fraud being played by the petitioner. At the same time, the petitioner has got criminal

Patna High Court Cr.Misc. No.18860 of 2018(2) dt.06-04-2018 2/2 antecedent of six identical cases.

Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner, namely, Md. Shabbir @ Shabir is rejected. (Shivaji Pandey, J) rishi/- U T
