JUSTICE SANJAY PRIYA ORAL ORDER 2/ 22-04-2019 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner seeks bail in Salakhua P.S. Case No.174 of 2018 instituted for the offence under Section(s) 498-A, 364, 365/34, 304-B, 302, 201 Indian Penal Code.
Counsel for the petitioner submits that petitioner is step father-in-law of the deceased, Baby Devi. In the written report, it is alleged that daughter of the informant was married about four years ago with Amar Yadav, son of late Brahmdeo Yadav as per Hindu rites. Patna High Court CR. MISC. No.25103 of 2019(2) dt.22-04-2019 2/3 did not eat and fled away in the house of her cousin mother-inlaw. She was traceless from the next morning. It is stated that Samdhi, Ramdeo Yadav, (petitioner) told the informant that Amar Yadav, husband of Baby Devi had taken her somewhere about 15 days ago, but no information was given by the accused persons.
Counsel for the petitioner submits that wife of the petitioner has already been granted bail by co-ordinate Bench of this Court by order dated 10.04.2019 passed in Cr. Misc. No.6786 of 2019.
In the written report, there is no allegation of specific overt act against the petitioner.
Counsel for the informant has opposed the prayer for bail.
Petitioner is in custody since 16.01.2019.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed.
