The petitioner seeks bail in connection with Bhabua P.S. Case No. 616 of 2018 instituted for the offence under Section(s) 386/34 of the Indian Penal Code.
Learned counsel for petitioner has submitted that petitioner is not named in the written report. Informant has named two accused persons, namely, Munna Yadav @ Monu and Om Prakash Yadav in the FIR. He further submits that the name of this petitioner has come during investigation in the confessional statement of co-accused, namely, Prem Yadav @ Sipahi Yadav @ Hargendra Yadav. The police after arresting this petitioner has recorded his confessional statement. Learned APP for the State has submitted that three
Patna High Court CR. MISC. No.24099 of 2019(2) dt.15-04-2019 2/2 other cases are pending against this petitioner. Learned counsel for petitioner submits that petitioner is on bail in all those cases. Learned counsel for petitioner further submits that one of the co-accused, namely, Krishna Yadav has already been granted bail by this Hon'ble Court by order dated 16.01.2019 passed in Criminal Miscellaneous No. 77560 of 2018.
Petitioner is in custody since 19.11.2018.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Kaimur at Bhabua in connection with Bhabua P.S.
