07-07-2015 Heard Sri Prabhu Nath Roy, learned senior counsel, who was assisted by Sri Amlesh Kumar Verma, learned counsel for the petitioner and learned A.C. to Standing Counsel - 12. The present writ petition pertains to a dispute under the Bihar Tenancy Act, 1885, which is a scheduled Act under the provisions of Bihar Land Tribunal Act, 2009. Since the Tribunal, constituted under the Bihar Land Tribunal Act, 2009, is already functioning, the Court considers that this matter can well be adjudicated by the Tribunal.

Accordingly, in terms of proviso to Section 15 of the Bihar Land Tribunal Act, 2009, the Registry is directed to transmit the record of this case to the Tribunal forthwith. Earlier, by order dated 17-05-2011, it was indicated that till appearance of respondent no. 4, the operation of the order dated 22-02-2011 contained in Annexure - '8' shall remain stayed. The order of stay is, hereby, confirmed.
