In this case, the petitioner is seeking regular bail in connection with Sessions Trial No. 311 of 2014, arising out of Agamkuan P.S. Case No. 209 of 2013, registered for the offence under Sections 302/120(B)/34 of the Indian Penal Code and under Section 27 of the Arms Act.
This Court, on earlier occasion, had called for the status report regarding stage of trial. In pursuance of the said order, the Additional District and Sessions Judge, XVIII, Patna, has sent the report mentioning therein that the trial was pending for further argument on behalf of the defence but, due pandemic, no argument could be made from the side of the
Patna High Court CR. MISC. No.22521 of 2020(3) dt.02-11-2020 2/2 defence and requested for six months' time to conclude the trial. Learned counsel for the petitioner submits that the petitioner is in jail for more than seven years and during the evidence nothing has come out against him, so this Court may release the petitioner on bail.
Considering the report of the Court below, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected for the present. However, this Court directs the Court below to complete the argument of both the sides on day-to-day basis without giving any adjournment to any party and conclude the trial within two months from the date of receipt / production of a copy of this order. The Court below, if so liked, may call for the written argument from both the sides.
However, it is made clear that this order will be subject to cooperation extend by the accused persons. (Shivaji Pandey, J) pawan/- U T
