The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420/423/465/467/468/471/120B/506/34 of the Indian Penal Code. According to F.I.R. the informant had purchased a land through registered sale-deed from this petitioner. When the informant went for mutation of the land she was informed that the land was of the government.

Considering the fact that primary responsibility is of the purchaser to verify the title of her vendor including encumbrances on the land as well as considering the fact that there is no direct material against the petitioner, let the petitioner, above

No.36023 of 2017 (2) dt.10-08-2017 P2/ named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan/successor Court in connection with Pachrukhi Police Station Case No. 80 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
