JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Ara Town P.S. Case No. 59 of 2018 registered for the offences punishable under Section 414 of the Indian Penal Code. It is stated that co-accused, Manu Mahto was arrested with stolen motorcycle and disclosed that aforesaid motorcycle belonged to petitioner.
Submission on behalf of the petitioner is that except the aforesaid so-called confessional statement, there is nothing against the petitioner.
In my view, it is not a fit case for grant of anticipatory bail because confessional statement of co-accused is
Patna High Court Cr.Misc. No.19289 of 2018 (2) dt.05-04-2018 2/2 relevant for the purpose of investigation.
Accordingly, I am not inclined to extend the privilege of anticipatory bail to the petitioner. Hence, his prayer for anticipatory bail stands rejected.
