Petitioners seek anticipatory bail in Piro P.S. Case No.107 of 2017 instituted for the offence under Sections 302, 120(B)/34 of the I.P.C. and Section 27 of the Arms Act. Informant who is younger brother of the deceased in his F.I.R. has stated that on 09.05.2017 at about 10 A.M. received information that his elder brother, Abdul Kabari had been killed and his dead body was sent for postmortem examination. It is alleged that the deceased had two wives and co-accused Md.Mubarak Ansari being the first husband of second wife, Jaida Begam, of the deceased had once threatened the elder brother of the informant to kill him.

No.2486 of 2018 (2) dt.17-02-2018 2/2 It has been submitted by the counsel for the petitioners that they are not named in the F.I.R. but their names have been taken in course of investigation by the informant only on suspicion. They have no criminal antecedent. It has further been submitted that similarly situated co-accused, Md. Mubarak Ansari has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 20.09.2017 passed in Cr.Misc.No.33121of 2017.
Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the Addl. C.J.M.-1,Ara, Bhojpur, in Piro P.S.Case No.107 of 2017 subject to the condition as laid down under Section 438(2) of Cr.P.C. (S. Kumar, J) AnilKrSinha/- U
