1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Muffasil Police Station Case No. 280 of 2024, disclosing offences under Sections 08, 20(b)(ii)(B) of the NDPS Act and Sections 123 and 275 of the BNS, 2023.
3. As per the prosecution case, on 04.07.2024, while on patrol, informant received a secret information about a Tata Ace pick-up transporting drugs and arms. He intercepted the vehicle and found two individuals inside the vehicle who disclosed their identities. Upon searching the vehicle, informant recovered 25 bags of Vimal Pan Masala, 5 bags of Bimal Patti, Sweet Supari, 3 bags of Signature Pan Masala, and 500 grams

Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in the present case due to ill motive of the police personnel. No incriminating contraband has been recovered from the conscious possession of the petitioner. Petitioner was not apprehended from the spot. Petitioner has been made accused merely on the basis of disclosure of his name by the arrested co-accused who is having inimical terms with the petitioner. Petitioner has no concern with the alleged vehicle and the seized articles.
5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation, recovery of contraband/ganja and the petitioner is having criminal antecedents, I am not inclined to grant the petitioner privilege of anticipatory bail.
