NILU AGRAWAL ORAL ORDER 14-12-2015 Heard learned counsel for the petitioners and learned Special P.P. for the State.
The petitioners apprehend their arrest in connection with Digha P.S.Case No. 150 of 2015 registered for offences punishable under Sections 341, 323, 504, 379, 34 of the Indian Penal Code and 3 (1) (x) of S.C./S.T. Act.
The prosecution case is that the informant being a Principal of Women Industrial Training Institute, Digha Ghat, Patna on 12.05.2015 at about 5 P.M. he reached at Veranda from
Patna High Court Cr.Misc. No.52543 of 2015 (4) dt.14-12-2015 2/3 his office to go to his house. In the meantime, secretary of ITI Premchand Sinha, Shri Sanjay Kumar along with other accused persons/staffs came there and started raising slogan and started to abuse him by naming caste. Informant asked that the matter may be resolved in a meeting but accused Prem Chand Sinha and Sanjay Kumar caught his neck and tried to press the same. Other accused persons assaulted him by slaps. It is further alleged that they also took out Rs. 1000/- from his possession and tried to snatch his mobile.
Learned counsel for the petitioners has been submitted that there was a mob of 30 to 40 people, who were raising slogans against the informant. It has further been stated that all the petitioners are employees of the Women Industrial Training Institute, Digha Ghat, Patna and all the petitioners have clean antecedents as is evident from para-3 of this petition. Be that as it may, let the above named petitioners, in the event of their arrest or surrender before the Court below within a period of six weeks from today be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Patna in connection with Digha P.S.Case No. 150 of 2015 subject to the conditions laid down under Section 438

However, it is made clear if the petitioners are involved in similar nature of offence in future, as the present one, the learned Court below will be liberty to cancel the bail bonds of the petitioners without being prejudiced with this order. (Nilu Agrawal, J) Sudha/- U T
