The petitioner apprehends his arrest in Mohammadpur P.S. Case No. 154/2015, registered for the offences punishable under Section(s) 304B, 498A, 120B/34 of the Indian Penal Code.
Prosecution case in brief is that accused persons including the petitioner killed the victim due to non-fulfillment of demand of dowry.
It is submitted on behalf of the petitioner that petitioner has been falsely implicated in this case. Petitioner is brother-in-law (Dewar) of deceased. Petitioner is living at Chandigarh. He has no concern with the family affairs of his brother or the deceased. From Annexure-2 series, it is evident
Patna High Court CR. MISC. No.27221 of 2019(3) dt.17-07-2019 2/2 that deceased died due to illness.
Considering the facts aforesaid and the fact that petitioner is brother-in-law of the deceased, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Gopalganj in connection with Mohammadpur P.S. Case No. 154/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
