Petitioner seeks regular bail in connection with Shahpur Patori P.S. Case No. 18 of 2020 registered for the offence under Section 395 of the I.P.C.
The allegation as per the First Information Report is that the petitioner along with some unknown persons entered into the L.I.C. Office at Shahpur Patori Branch and looted a sum of Rs. 10,71,803/- on gun point.
Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and his name has transpired on the basis of confessional

Learned counsel further submits that a sum of Rs. 19,500/- was recovered from his house but that amount belongs to the petitioner for which he has filed a petition for release of the money before the learned court below. Learned counsel further submits that other co-accused persons namely, Mantu Kumar @ Mantu Kumar Singh, Dilip Rai @ Dileep Kumar Ray and Suresh Kumar have been granted bail by this court in Cr. Misc. No. 19174 of 2020, Cr. Misc. No. 23047 of 2020 and Cr. Misc. No. 25383 of 2020 respectively. On the other hand, learned counsel for the State referring to the case diary submits that petitioner has got four criminal antecedents, he is a habitual offender and the looted amount has been recovered from his house, which the petitioner has accepted in his confessional statement as such he does not deserve the privilege of bail.
Having heard learned counsel for the parties and taking into consideration the materials available on record , I am inclined to grant regular bail to the petitioner upon completion of one year in custody.
Accordingly, let the petitioner, above named, be released on regular bail upon completion of one year in custody on furnishing bail bond of Rs. 25,000/- (twenty five

No.26559 of 2020(4) dt.04-12-2020 3/3 thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - IV, Samastipur in connection with Shahpur Patori P.S. Case No. 18 of 2020 on the following condition:- (i) that the petitioner shall remain present on each and every date during the course of trial and in case of default on two consecutive dates on the part of the petitioner, his bail bond shall liable to be cancelled.
It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
