1. Heard learned counsel for the petitioner and learned APP for the State.

2. The learned counsel for the petitioner submits that the petitioner is aggrieved by an order passed by the SDO whereby possession of the O.P. No. 2 over the land in question has been confirmed and the order of the SDO has been affirmed by the learned Additional Sessions Judge-VIII, Gopalganj in Criminal Revision No. 672 of 2015, it is next submitted that petitioner, aggrieved by the order of the SDO and the learned Sessions Judge, has preferred the present quashing application. The learned counsel submits that the land in question came to the petitioner by way of a settlement made by Hathua Estate

Patna High Court CR. MISC. No.40127 of 2017(2) dt.19-10-2023 2/2 whereas the case of the O.P. No. 2 is that the land in question was received by them though Bhoodan.

3. The issue, thus, involved in the present case is disputed, as such, this Court is not inclined to entertain te quashing application.

4. Accordingly, the present quashing application stands rejected.

5. However, the petitioner would be at liberty to move before the appropriate forum seeking appropriate relief in accordance with law.
