JUSTICE RAKESH KUMAR ORAL ORDER 08-07-2015 Heard Sri Awadhesh Kumar Mishra, learned counsel for the petitioner, learned AC to SC No. 20 and Sri Jibendra Mishra, learned counsel for the private respondents. The present writ petition pertains to a dispute under Section 48(E) of the Bihar Tenancy Act, 1885 which is a scheduled Act under the provisions of Bihar Land Tribunal Act, 2009.

Since the Bihar Land Tribunal constituted under the Bihar Land Tribunal Act, 2009 is already functioning, the court considers that this matter can well be adjudicated by the Bihar Land Tribunal.

Accordingly, in terms of proviso to Section 15 of the Bihar Land Tribunal Act, 2009, the Registry is directed to

Patna High Court CWJC No.18802 of 2011 (4) dt.08-07-2015 2/2 transmit the record of this case to the Bihar Land Tribunal forthwith.
