2. Petitioner seeks regular bail in connection with Muffasil (Singhaul O.P.) P.S. Case No. 576 of 2023 dated 03.10.2023 registered for the offences punishable under sections 143, 341, 323, 307, 379, 504 and 385 of the Indian Penal Code.

The main submissions advanced by petitioner's counsel are that in between both the parties, there is a land dispute and there is a case and counter case between them and as per the FIR, the alleged occurrence took place on 26.09.2023 but the FIR was lodged on 03.10.2023 after the delay of 7 days, regarding which, there is no proper explanation and 4 co-accused persons, who were named in the FIR, have been granted the relief of anticipatory bail by a co-ordinate Bench of this Court vide orders dated 07.03.2024 and 27.03.2024 passed in Cr. Misc. Nos. 8629/2024 and 24524/2024 respectively. It is further

No.23494 of 2025(2) dt.30-04-2025 2/2 submitted that as per the allegation, the petitioner is alleged to have assaulted at the head of the injured, namely, Rupesh Kumar from the butt portion of pistol but the injury found on his head was opined to be simple in nature, though one injury on his nasal bone has been opined to be grievous in nature but the same is not attributed to this petitioner. It is lastly submitted that the petitioner has been languishing in jail since 05.02.2025 and against him, the investigation has been completed.
4. Learned APP for the State has opposed the prayer of the petitioner.

In the facts and circumstances of this case as well as considering the aforesaid submissions and mainly the nature of allegation appearing against this petitioner, this Court is inclined to grant the relief of bail to the petitioner. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Muffasil (Singhaul O.P.) P.S. Case No. 576 of 2023.
