Petitioner seeks bail in connection with Jakkanpur P.S. Case No. 140 of 2019 registered for the offence punishable under sections 30(a), 38 of the Bihar Prohibition and Excise Act and section 120B of the Indian Penal Code.

The seizure list reflects recovery of 73 liters and 125 ml of illicit liquor.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case merely on suspicion. Nothing has been recovered from the conscious possession of this petitioner. As a matter of fact, after investigation, the police did not submit charge-sheet against this

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Patna in connection with Jakkanpur P.S. Case No. 140 of 2019.
