JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 363, 366A, 504, 506, 34 of the Indian Penal Code and u/s 8/12 of POCSO Act.

As per the prosecution case, this petitioner along with other accused persons kidnapped the minor daughter of the informant.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No such occurrence as alleged in the FIR has ever taken place. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that victim in her

Patna High Court CR. MISC. No.26283 of 2022(3) dt.22-11-2022 2/2 statement u/s 164 of the Cr. P. C. fully supported the prosecution case.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
