2. The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 316(2)/318(4)/3(5) of the BNS.

3. As per the prosecution story, it is alleged that this petitioner in connivance with other co-accused persons embezzled an amount to the tune of Rs. 4,46,346/- deposited by the borrowers. It is further alleged that this petitioner who was the Branch Manager of the Bank fled away with an amount of Rs. 74,547/-

4. Learned counsel for the petitioner submits that from bare perusal of the F.I.R., it is apparent that the petitioner is alleged to have misappropriated Rs. 74,547/- which he is ready to deposit in installments. Petitioner claims clean

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Samastipur Town P.S. Case No. 220/2024, subject to the conditions laid down in Section 482 of the BNSS with further following conditions:

"(A) At the time of furnishing bail-bond, the petitioner shall deposit Rs. 50,000/- in the Nazarat of concerned Civil Court and receipt of the same shall be furnished. (B) Rest amount of the amount shall be deposited in the Nazarat of concerned Civil Court in two equal installments within a period of three months from the date of furnishing bailbond. (C) The aforesaid payment shall be subject to final outcome of the case.

7. This order has been passed, without going into the merit of the case, only for the purpose of considering the prayer for anticipatory bail of petitioner.
