====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 11-04-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Amdabad P.S. Case No. 175 of 2018, instituted for the offence under Section(s) 302 and 120(B) of the Indian Penal Code.

Counsel for the petitioner submits that mere suspicion has been raised against the petitioner in the written report.

It is alleged in the written report that son of the informant namely, Sk. Pappu went to see the fair and did not return home till night. It is alleged that Sk. Idul came on Motorcycle and told the informant that her son has already returned home. The informant made search but she did not get any trace of her son. It is alleged that Sk. Tasua had dropped

In course of search, the informant found dead body of her son on 6.10.2018 in a ditch filled with water situated at Jaliyamari Bahiyar. The informant has raised suspicion against the petitioner and other co-accused that they murdered her son.

Petitioner is in custody since 12.10.2018.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri D. Singh, learned Judicial Magistrate, 1st Class, Katihar, in connection with Amdabad P.S. Case No. 175 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
