JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 2 14-08-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Siwaipatti P.S. Case No. 58 of 2019 for the offence under Sections 356 and 379 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 27.08.2019.
Learned counsel for the petitioner submits that the petitioner was not named in the FIR and he has been made accused only on the basis of confessional statements of coaccused Arjun alias Radhe and Anish Kumar. He further submits that nothing was recovered from possession of the petitioner and there is no material to connect the petitioner with the commission of crime. Petitioner has not been put on T.I. parade for identification in the case.
Considering the fact that the petitioner was not named in the FIR and he is in custody since 27.08.2019, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-cum-S.J. 9th, Muzaffarpur in connection with Siwaipatti P.S. Case No. 58 of 2019.
