This is an application for grant of anticipatory bail in connection with Pakaridyal P.S. Case No.145 of 2017 registered for the offence punishable under Sections 341, 323, 324, 307, 504, 34 of the Indian Penal Code.

The case of the prosecution is that the accused persons are said to have assaulted the son of the informant. The learned counsel for the petitioner submits that the main allegation of assault is against one Roop Narayan and as far as the petitioner is concerned, no specific allegation of overt act has been levelled. It is further submitted that the petitioner is having a clean antecedent.

Patna High Court Cr.Misc. No.8329 of 2018 (3) dt.26-02-2018 2/2 Per contra, the learned counsel for the informant has vehemently opposed the prayer of bail.

Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail, in the even of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Motihari in connection with Pakaridayal P.S. Case No.145 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
