Petitioners in the present case are seeking anticipatory bail in connection with Complaint Case No. 1821-C of 2017 registered for the offences punishable under Sections 323/341/379 of the Indian Penal Code.

Learned counsel for the petitioners submits that in the complaint case the learned Magistrate has taken cognizance of

Patna High Court CR. MISC. No.25244 of 2019(3) dt.29-07-2019 2/2 the offence alleged under Sections 323/341/379 of the Indian Penal Code. It is submitted that the allegations made against the petitioners are false and baseless and in fact the complainant happens to be the full brother of petitioner no. 3. A land dispute is said to be going on between the parties.

The prayer for anticipatory bail has been opposed by the learned A.P.P. for the State.

Considering the facts and circumstances of the case and nature of the allegations, let the petitioners above named, in case of their arrest or surrender within four weeks from today in connection with Complaint Case No. 1821-C of 2017, be released on bail on execution of bail bonds of Rs. 15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
