The petitioners seek anticipatory bail in Korma P.S. Case No.44 of 2017 instituted for the offences under Sections 147, 148, 149, 341, 323, 337, 338, 307 and 504 of the Indian Penal Code.
It has been alleged that group led by Sarpanch and group led by Md. Sultan have entered into scuffle due to earlier case and dispute. Both sides armed with lethal weapons. In such view of the matter, this Court is not inclined to enlarge the petitioners on anticipatory bail. Accordingly the
Patna High Court Cr.Misc. No.41006 of 2017 (2) dt.22-09-2017 prayer for bail is rejected. However, if the petitioners surrender before the court below within a period of t four weeks from today, the court below will pass an order on its own merit without being prejudiced by the order passed by this Court.
