The petitioner apprehends his arrest in connection with Dumraon P.S. case no. 59 of 2016 registered under Sections 457 and 380 of the IPC.

While the informant was away, it is alleged, that his house was broken open and theft was committed. On the confessional statement of co-accused, the name of the petitioner surfaced. The house of the petitioner was also searched wherein one fire arm weapon was recovered. Said weapon finds mention in the list of items said to have been stolen in the occurrence. Naming of the petitioner by the co-accused and subsequent recovery of one of the stolen articles, in my view, does not merit grant of anticipatory bail.

Patna High Court Cr.Misc. No.35423 of 2016 (2) dt.17-09-2016 2/2 Prayer is, accordingly, rejected.
