The petitioner apprehends his arrest in Forest Case No. 4 of 2019, registered for the offences punishable under Sections 5, 14 of the Bihar Saw Mills (Regulation) Act and sections 41, 42 of the Indian Forest Act.

Prosecution case in brief is that three pieces of Chiran wood were seized from the Saw Mill of petitioner. It is submitted that petitioner has been falsely implicated in this case. Petitioner has got 18" diameter Saw Mill for manufacturing of furniture which is exempted from the purview of 25 of the Bihar Saw Mills (Regulation) Act, 1990 and Resolution No. 3959 dated 24.12.2012 has also been isssued

Patna High Court CR. MISC. No.35495 of 2021(3) dt.23-06-2022 2/2 by the Department of Environment and Forest, Government of Bihar in which it is stated that no registration is required for 18" diameter Saw Mill and as such, no case under Section 5 and 14 of the Bihar Saw Mills (Regulation) Act and sections 41 and 42 of the Indian Forest Act.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in connection with Forest Case No. 4 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
