JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 498A, 323, 504 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
The basic accusation is of torture for nonfulfilment of dowry demand. The complainant claims to have married with the petitioner on 18.06.2014 and thereafter torture was inflicted.
It is submitted by learned counsel for the petitioner that petitioner was kidnapped for which the brother of the petitioner filed Complaint Case No. 1014(C) of 2014 on 24.06.2014 levelling accusation under Sections 364(A), 323, 386, 307, 544, 342 of the Indian Penal Code against the complainant's family which came to be registered as a police case on 01.05.2015, whereas the present complaint was filed on 01.07.2014.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.52617 of 2015 (2) dt.24-11-2015 2/2 complainant that during investigation the case lodged by the brother of the petitioner has been found false. Considering the fact that the case lodged by the petitioner's side is at earlier point of time, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jamui in connection with Complaint Case No. 1055C of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
