JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-10-2016 Heard learned counsels for the petitioner and the State. The petitioner being mother of the husband of the daughter of the informant is apprehending arrest in a case registered for the offences punishable under Sections 498A,304B and 201/34 of the Indian Penal Code.

The prosecution case is of killing the daughter of the informant within two years of marriage for non fulfillment of dowry demands and disposing of the dead body It is submitted by the learned counsel for the petitioner that the accusation is omnibus and general against the entire inlaws family including the petitioner and in fact the victim committed suicide. More over, co accused has been granted bail by a co-ordinate bench of this court vide Cr. Misc. No. 41493 of

Patna High Court Cr.Misc. No.32457 of 2016 (4) dt.20-10-2016 2/2 2015. The petitioner claims to be separate from the husband of the victim and is bringing up the infant baby of the victim. Learned APP, after going through the case diary, submitted that subsequently highly decomposed dead body of the daughter of the informant was recovered from a river and the accusation is against the entire inlaws family of killing the victim. Considering the fact that co accused has been granted bail, let the learned court below consider the prayer for bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Dighwara P.S. Case No. 65 of 2015 pending in the court of learned A.C.J.M.-2, Saran at Chapra. This application is disposed of with the aforesaid observation/direction.
