The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 3(2)(e) of the Prevention of Damage to Public Property Act, 1984. The accusation against the four FIR named accused persons including the petitioners and seven unknown is of disrupting the water supply of the informant in the background of municipal election dispute.

It is submitted by learned Counsel appearing on behalf of the petitioners that the accusation is not specific against the petitioners and has been registered in the background of election dispute, for which, earlier, another case has also been

Patna High Court Cr.Misc. No.47701 of 2017(2) dt.17-10-2017 2/2 lodged. Moreover, the informant is not the eye witness to the occurrence. Statement has been made in paragraph no.3 of the petition that petitioners are accused in one other case in which they are on bail.

Considering the nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-1, Nalanda at Biharsharif, in connection with Silao P.S. Case 103 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
