In this case, petitioners are challenging the order dated 9th June 2016 arising from Complaint Case no. 3094(C)/2015.

The court below, on the basis of material available on record, has taken cognizance under sections 498(A) and 504/34 of the Indian Penal Code.

The counsel for the petitioners submits that already there is divorce from the opposite party no. 2. The petitioner is ready to pay compensation amount, but the opposite party no. 2 is not ready to accept the compensation amount, as she does not accept the divorce.

In such view of the matter, this Court is not inclined

Patna High Court Cr.Misc. No.31168 of 2016 (4) dt.27-10-2016 2/2 to interfere with the order of cognizance.

Accordingly, this petition is dismissed.
