2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 323, 324, 307, 385, 387/34 of the Indian Penal Code.
3. As per allegation in the FIR, co-accused Nagina Sahani, Chhota Babu Singh and this petitioner inflicted knife blow to the uncle and father of the informant due to nonfulfillment of rangdari demand.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to village politics. There is delay of three days in lodging the FIR, without any proper reason. Both parties are co-villagers and
Patna High Court CR. MISC. No.25568 of 2023(3) dt.26-07-2023 2/2 there is no allegation of repeated blow. Petitioner has got no criminal antecedent and languishing in judicial custody since 12.11.2022.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sikarhana, Dhaka, Motihari, East Champaran in connection with Kudawa Chainpur P.S. Case No. 201 of 2022.
