The petitioner apprehends his arrest in connection with Bhagwanpur P.S. Case No. 118 of 2017 registered for the offence punishable under Sections 341, 323, 354(B), 504/34 of the Indian Penal Code.
Informant is the brother of the victim, who in his written complaint dated 20.08.2017 has alleged that while they were sleeping on the roof of their house at about 1:00 am petitioner came there and tried to outrage the modesty of his sister and after seeing this all the family members went before the father of the petitioner to make complaint against petitioner where they were humiliated and assaulted and they sustained
Patna High Court Cr.Misc. No.1856 of 2018(3) dt.20-02-2018 2/2 injury on account of the said assault. Injury report has been enclosed as Annexure-3 in which the injuries have been found to be simple in nature. It has been further submitted that there is counter case also filed by the father of the petitioner in which also there is allegation of assault against the informant in which they had also sustained injuries.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1st, Kaimur in connection with Bhagwanpur P.S. Case No. 118 of 2017 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
