JUSTICE RAVI RANJAN ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 504 of the Indian Penal Code and Section 25 (1-B)a, 26, 27 and 35 of the Arms Act.

It is contended that cause of altercation, as would emanate from the First Information Report, is that the informant's side has kept the heap stone chips and sand on the land of the petitioner's side. Allegation is that on the next day, the petitioner's side came with firearms, directed them to remove the sand and stone chips and started assaulting by lathi danda. The petitioner allegedly fired from his pistol. When the police came, all of them fled away.

Patna High Court Cr.Misc. No.31172 of 2016 (2) dt.09-08-2016 2/2 There is recovery of pistol from the agricultural field of Dinesh Yadav. It is contended that nothing has been found from the possession of the petitioner or even from his field. It is urged that petitioner's antecedent is clean.

Having regard to the facts and circumstances of the case, let the petitioner, namely, Pintu Yadav @ Pintu Jadav be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Nalanda P.S. Case No.66/2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
