JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420, 467, 468, 498A, 353, 504 and 506 of the Indian Penal Code.
The prosecution case is that the petitioner made complaint against one Sabnam Ara, an Assistant Teacher, Middle School, Nauhatta about her forged educational certificate but on enquiry the allegation was found false, hence, the District Programme Officer, Saharsa directed the Block Development Officer to lodge FIR and consequently, the FIR was registered. It is submitted by learned counsel for the petitioner that even assuming the accusation, no offence as alleged is made out, moreover, as the accusation levelled no offence under Section 498A IPC is made out.
Considering the nature of accusation, let the above
