Petitioners are apprehending their arrest in a case registered for offences punishable under Sections 406, 427, 409, 420/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that the petitioners are the brother of the co-accused Tahir Hussain, against whom the specific allegation has been levelled and petitioners have no role to play in execution of the alleged land. Heard learned A.P.P. also.

Having heard both sides and in view of the fact the specific allegation is against the co-accused, namely Tahir Hussain, this application is allowed.. Let the petitioners, above named, in the event of their arrest or surrender before the court below within a

Patna High Court Cr.Misc. No.49583 of 2016 (2) dt.19-12-2016 2/2 period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Siwan, in connection with Ziradei P.S. Case No. 65 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
