Heard the parties in virtual Court.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341,323,379,307,504,506/34 of the Indian Penal Code. For trivial dispute, petitioner No.3-Raju Yadav allegedly caused injury with Lathi at the head of the informant. Other petitioners bear general and omnibus allegation of commission of assault.
Since petitioner No.3-Raju Yadav had knowledge that his act might cause death, I am not inclined to enlarge him
Patna High Court CR. MISC. No.28341 of 2020(2) dt.09-12-2020 2/2 on anticipatory bail. Hence prayer is refused. He may surrender and pray for regular bail.
Let petitioner Nos. 1 and 2, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Banka (Barahat) P.S.Case No. 923 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioners shall fully cooperate with the investigation/trial of the case and also the petitioners shall not leave the country without permission of the learned Trial Court, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
