JUSTICE SHIVAJI PANDEY ORAL ORDER 10-07-2017 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking anticipatory bail in connection with Sono P.S. Case No. 159 of 2016, registered for the offence punishable under Sections 341, 323, 324, 307, 379, 354A, 448 and 504/34 of the Indian Penal Code. Allegation has been against the petitioner that he has entered into the house of the informant and started outraging the modesty of the female members of the family. Learned counsel for the petitioner submits that the story which has been made in the F.I.R. is completely incorrect, in fact, the present petitioner and the informant of this case were living in Ludhiyana and he has handed over Rs.5000/- along

Patna High Court Cr.Misc. No.19768 of 2017 (3) dt.10-07-2017 2/2 with one mobile phone to hand over the same to the family members, but instead of handing over, he has swallowed the same. When he came for return of money as well as mobile and showed his inability that is the cause of altercation. Looking to the facts and circumstance of the case and also the fact that the witnesses have made the statement against this petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. If the petitioner surrenders before the Court below within four weeks from today and prays for bail, the Court below will pass the order in accordance with law on the same day without being influenced by the order of this Court.
