2. The petitioner apprehends his arrest in a case registered for offence under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.

3. On a secret information that some miscreants have assembled to commit a crime, a raid was conducted, in which three persons were arrested on spot and arrested persons disclosed the name of this petitioner, as the person who fled away from the spot.

4. Learned counsel for the petitioner submits that petitioner has been named by the apprehended accused persons due to enmity. No stolen / incriminating article has been recovered from the possession of this petitioner.

5. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that name of the petitioner surfaced in the confessional statement of co-accused, who was apprehended on spot. He further submits that petitioner has got three criminal antecedent, out of which, one case is of similar nature.

6. Considering the same, the prayer for anticipatory bail of petitioner is rejected.
