JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2018 Petitioners apprehend their arrest in connection with Bhabhua P.S.Case No. 13 of 2018 registered under Sections 307, 504, 34 of the Indian Penal Code and 27 of the Arms Act. Allegation against the petitioners is that on the order of petitioner No.1, petitioner No.2 fired in the air and no injury was caused to anybody. It further appears that petitioner No.1 has been made accused in seven other cases.

Submission of learned counsel for the petitioners is that petitioner No.1 has been granted bail in all other cases and in the present case there is no injury on the person of informant and firing was made in the air on the order of petitioner No.1 by petitioner No.2.

No.10787 of 2018 (2) dt.27-02-2018 2/2 Having heard both sides and in view of facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender, be release on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Bhabhua P.S.Case No. 13 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a close relative of the petitioners having sufficient immoveable properties within the jurisdiction of court concerned, (2) petitioners shall cooperate in investigation and appear before the Investigating Officer as and when required, except on genuine ground, failing which their bail bonds shall be cancelled and (3) if petitioner No.1 is involved in any other case in future, his bail bond shall be liable to be cancelled.
