2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 323, 341, 342, 458, 386, 387, 307, 504, 506 of the Indian Penal Code.

3. Allegation against the petitioner is that he along with other co-accused persons climbed on the roof of the informant and demanded amount of levy.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that the petitioner is a neighbor/co-villagers of the informant, he had taken land on patta for cultivation of his land and due to patta money dispute, the petitioner has been falsely implication in the present case. He submits that there is

Patna High Court CR. MISC. No.33212 of 2023(4) dt.21-12-2023 2/2 no specific overt act against the petitioner. There is general and omnibus allegation levelled against the petitioner. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.

5. Learned APP for the State opposing the prayer for bail submits that there is ample evidence against the petitioner in the case diary.

6. Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Bhadwar P.S. Case No. 03 of 2021.
