JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-04-2018 Heard the learned counsels for the petitioners, the informant as well as the State.
The petitioners seek bail in anticipation of their arrest in connection with Rajnagar P.S. Case No. 201/2017 dated 13.09.2017 instituted for the offences under Sections 147,148, 149, 341, 323, 324, 307, 379 and 427 of the Indian Penal Code. From the perusal of the F.I.R., it appears that several persons, including the petitioners, have been named and some of them have been alleged to have assaulted the informant and two others because of dispute over drainage of flood water. So far as the
Patna High Court Cr.Misc. No.15646 of 2018 (2) dt.05-04-2018 2/2 petitioners are concerned, there is no specific allegation of assault and but for their having been named in the F.I.R., no allegation has been made against them.
Considering the aforesaid facts, the petitioners above named are directed to be released on bail, in the event of their surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bond in the sum of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Madhubani in connection with Rajnagar P.S. Case No. 201/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
