The petitioners seek anticipatory bail in a case instituted for the offences under Sections 304(b)/34 and 201 of the Indian Penal Code.

Allegation has been made that after two years of marriage the victim has been killed. It has been alleged that petitioner no.1 (husband) was demanding a golden chain and motorcycle and in failure to satisfy the victim has been killed. Learned counsel for the petitioners submits that petitioner nos. 2 and 3 are sister-in-law and brother-in-law of the victim.

Patna High Court Cr.Misc. No.20987 of 2017 (3) dt.10-07-2017 Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioner nos. 2 and 3, namely, Shushila Devi and Manoj Rai, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Patna City in connection with Khusrupur P.S. Case No.106 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

So far petitioner no.1, Ratan Rai is concerned, this Court is not inclined to enlarge him on anticipatory bail. Accordingly his prayer for bail is rejected.
