This is an application for grant of anticipatory bail in connection with Amba P.S. Case No. 28 of 2013 registered for the offence punishable under Sections 384/34 of the Indian Penal Code and Section 17 of the C.L.A. Act.

The case of the prosecution is regarding one Deva Yadav, an associate of Sub-zonal Commander of MCC, namely, Vinay Yadav @ Vinay Jee @ Murad @ Guru Jee having been caught by the police and from his possession, a mobile set, a piece of paper containing names of nine persons, cash amount of Rs. 1,50,000/- and a motorcycle were recovered. Upon interrogation, the said co-accused disclosed that the said motorcycle belongs to the petitioner herein.

No.8510 of 2018(3) dt.03-04-2018 2/2 The learned counsel for the petitioner submits that no allegation had been levelled against the petitioner initially, but it transpired during the course of the investigation that the petitioner was not directly involved in the alleged crime but the motorcycle used by the co-accused belonged to him. It is further submitted that the petitioner is having a clean antecedent. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Amba P.S. Case No. 28 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) ajay gupta/- U T
