The petitioner seeks bail in anticipation of his arrest in connection with Sangrampur P.S. Case No. 50/2017 dated 06.04.2017 instituted for the offence under Section 387 of the Indian Penal Code.
The petitioner has not been named in the F.I.R. The informant alleges to have been threatened and demanded ransom from a person who disclosed his name as Kunal Singh. During the course of investigation, one Afroz Hussain was arrested, who was found to be in possession of the mobile telephone which was used for demanding ransom from the informant. Aforesaid Afroz Hussain named the petitioner as the person in whose name the SIM Card was issued by the Telephone Department. But for
Patna High Court Cr.Misc. No.15634 of 2018 (2) dt.05-04-2018 2/2 suspicion on the basis of aforestated materials, there is no evidence against the petitioner. In the earlier case lodged against the petitioner for similar type of offence, he has been granted bail. Considering the aforesaid facts and nature of material collected during the course of investigation, the petitioner above named is directed to be released on bail, in the event of his surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bond in the sum of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XIVth, East Champaran, Motihari in connection with Sangrampur P.S. Case No. 50/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
