The sole petitioner, apprehending his arrest in Ganga Bridge P.S. Case No.56/2016 registered for the offence under Sections 8/20(b) (ii) (c), 25 and 29 of the N.D.P.S. Act, has prayed for grant of anticipatory bail.

It was submitted by learned counsel for the petitioner that the petitioner has falsely been implicated by a person, who was in inimical term with him. He submits that falsely it was shown recovery of about 20 Kg. of Ganja from a car of the petitioner. It was case of the prosecution that while raiding party arrived, a pick-up van loaded with 280 Kg. of Ganja was found and just near the pick-up van, the petitioner present in his

Patna High Court Cr.Misc. No.42652 of 2016 (2) dt.09-11-2016 2/2 car and after noticing the raiding party, the petitioner fled away. This fact was disclosed by the driver of the car. Learned counsel for the petitioner further submits that the petitioner was suffering from serious ailment and, as such, there was no reason for participation in the occurrence. It was also argued that in a calculated manner, his car was placed near the pick-up van through a Crane only with a view to implicate the petitioner. Such submission may not be appreciated, particularly at the time where the petitioner is making a prayer for grant of anticipatory bail.

The petition stands dismissed.
