The petitioners seek anticipatory bail in a case instituted for the offences under Sections 409 and 420 of the Indian Penal Code.

Both petitioners are Panchayat Secretary. Allegation has been made that Panchayat Secretary has not presented file folder and merit list and on that account case has been lodged against them.

Learned counsel for the petitioners submits that at that time petitioners were not present in the office. Looking to the facts and circumstances of the case, in

Patna High Court Cr.Misc. No.20999 of 2017 (2) dt.10-07-2017 the event of arrest or surrender within four weeks from today, let petitioners, namely, Bhagwan Das Yadav and Dinesh Prasad Rai alias Dinesh Prasdad Rai, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Barh, Patna in connection with Maranchi P.S. Case No.5 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
