====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-04-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in connection with Azam Nagar P.S. Case No.172 of 2018/G.R. No.3080 of 2018 registered under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. as on the basis of the written report of the informant, the present case was instituted against unknown in respect of the murder of the mother of the informant. Further submission is that, in course of investigation, the name of the petitioner and one Basudeo Kewat surfaced in the confessional statement of the co-accused
Patna High Court CR. MISC. No.23641 of 2019(2) dt.12-04-2019 2/2 Manoj Kewat having their hand in the commission of the alleged offence. Except that, nothing has been collected by the Investigating Officer, during investigation, against the petitioner to show his involvement in the present case. Co-accused Manoj Kewat has already been granted bail by a Bench of this Court vide order dated 22.11.2018 passed in Criminal Misc. No.67261 of 2018. The petitioner is in custody since 05.02.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Katihar, in connection with Azam Nagar P.S. Case No.172 of 2018/G.R. No.3080 of 2018.
