The petitioner apprehends his arrest in connection with Kinjer P.S. Case no. 57 of 2015, registered under Section 366(A)/34 of the Indian Penal Code.

The accusation is of kidnapping of minor daughter of informant by this petitioner with the help of his family members with intention to perform marriage.

Learned counsel for the petitioner submits that, in fact, there was love affairs in between the petitioner and the victim, accordingly, victim moved with the petitioner and performed marriage in a temple. On 31.07.2015, statement of victim was recorded under Section 164 Cr.P.C. in which she has stated about moving with this petitioner according to her sweet will and thereafter she performed marriage with him and she resided in a rented house with this

Patna High Court Cr.Misc. No.47094 of 2016 (2) dt.15-12-2016 2/2 petitioner. Further submission is that the Medical Board assessed the age of victim below 18 years.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in connection with Kinjer P.S. Case No.57 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
